Court rules Hotels.com can’t be trademarked.

A federal appeals court has ruled against Hotels.com in its bid to trademark its name. The court ruled that “Hotels” is generic and descriptive of its business.

Here’s what it means for domain name owners:

1. Generic domain names are harder to trademark and thus harder to protect. For example, Candy.com would likely not be able to get a trademark. However, the use of a generic term not related to the principle product on the web site (e.g. Amazon.com) can still be trademarked.

2. It may be harder for Hotels.com and other generic domain owners to win under anti-cybersquatting and UDRP for typos, although UDRP panels are fairly liberal about assuming common law trademarks even when a federal government has rejected a trademark application.

3. Filing a trademark for one your domain names as a preemptive measure may become more difficult.

MediaPost points out that it would be easier for other companies to bid on Google Adwords for your domain name, too.

It’s important to stress that the problem here is that Hotels.com is all about hotels, meaning Hotels.com was merely descriptive. This doesn’t mean that other domain names can’t be trademarked.

Latona makes two smart moves.

I was a little surprised to receive a press release from Rick Latona Auctions this week about an upcoming online auction, scheduled to start July 23. What concerned me was that I hadn’t heard about the auction until just this week and Latona was still accepting submissions. That could be a recipe for disaster. But hey, it’s his show.

Today Latona made two great moves in one: he canceled this week’s auction and announced a new theme for an auction next month: CPA/Lead generation domain names. It’s a huge market, although many lead generation companies view buying domains for traffic as too expensive. Nevertheless, I think this is a great theme if Latona can reach out to the affiliate community before the auction.

It always surprises me how most domainers are stuck in a pay-per-click mentality. The truth is, there are many lead generation firms out there that make domainers’ profits look like drop in the bucket. Merging the two worlds between domain names and pay-per-action/lead would be a home run. I guess it will take both sides educating each other rather than arguing that one is better than the other.

NameJet.com sent out an e-mail tonight reminding everyone that the .cm Landrush ends next week on July 30 at 5pm EST.

In the e-mail it lists the “Most Popular .cm Pre-orders” and for me there are quite a few surprises on the list.

You know my opinion on these domains, if its isn’t trademarked and generic, I have no problem with them. If its a trademarked term or the .com is trademarked, like Tv.com, stay away.

Before you attack, take the time to remember that there has been some huge dollars sales of  generic  .com typo’s in the past, such as Mortage.com ($242,000), Voyuer.com for $112,000, Downlaod.com for $68,000, Donwload.com for $68,000, Dawnload.com for $68,000, all of which sold without any outcry from the domain community.

IAC (NASDAQ: IACI) announced that it has signed an agreement to acquire People Media from American Capital Ltd (NASDAQ: ACAS).

People Media had $11.6 million of EBITDA in 2008 and operates 27 dating sites including BlackPeopleMeet.com, SingleParentMeet.com, SeniorPeopleMeet.com, BBPeopleMeet.com and LDSPlanet.com, with a combined 255 thousand paying subscribers.
